Fact Check: New Law Does NOT Force Hungarian Apartment Residents To Surrender Real Estate To Building's Legal Entity Not A Taking

Will an amendment to Hungary's 2021. XCII. law require apartment residents to give their real estate to the apartment building's legal entity? No, that's not true: The amendments take effect in July 2023, but it won't change the real estate ownership. The law only relates to the record keeping of legal entities.

The claim appeared in a video (archived here) shared in a Hungarian-language Facebook post published by @egyszocialista on TikTok on April 10, 2023. It opens with this (translated into English by Lead Stories staff):

XCII of 2021, which enters into force on July 1., 2023 designates apartment buildings as legal entities based on § 2 (4) point 11, § 101 (2) and § 102 (1).

After the amendment, apartment buildings will become legal entities like companies, NGOs or foundations. VG.hu asked Agnes Bek, the president of the National Association of Apartment Buildings and Apartment Building Maintainers about the change. VG.hu quoted him as saying the amendment is beneficial for owners as bureaucracy will become easier if they are represented by a legal body.
